Metrolink Pedestrian Accidents

Metrolink is a commuter train system that operates in Southern California. It has seven dedicated lines that serve almost 12 million riders a year. It operates in the counties of Los Angeles, Orange, Riverside, San Bernardino, Ventura and San Diego.

With this many routes and riders, there are bound to be accidents involving pedestrians. When a train hits a pedestrian the results are devastating and often fatal.

Metro Tain Liability

In California, fault in an auto accident can be assigned to anyone involved by a percentage of their negligence, and each person will be responsible for their percentage of the damages.

When it comes to pedestrians, it seems logical that a person walking on train tracks is automatically going to be negligent. However, since the law assigns a percentage to each, it may be that an injured pedestrian is deemed partially responsible and can still get damages.

Also, there are many valid reasons for someone to be on the tracks where they could get hurt. There may be inadequate signage and safety measures to protect pedestrians or a host of other reasons. If you’ve been injured or have lost a loved one from a Metrolink train accident, don’t take the word of the insurance company that you are to blame. Call an attorney who knows the law and your rights.
