Pedestrian Deaths on the Rise in LA

Over the past five years, pedestrian accidents have been on the rise all while the total number of fatalities has generally fallen over the last several decades. Around 6,000 pedestrians die each year in the U.S., and Los Angeles gets its fair share.

In 2015, 74 pedestrians died in the city and in 2017 the number increase 80% to 134. This despite Los Angeles having implemented its Project Zero program that has a goal of zero deaths by auto vehicles by 2025. One reason for this might be an increase in pedestrians on the roads and sidewalks because of LA’s attempt to get people out of their cars and on the streets.

Los Angeles Pedestrian Wrongful Deaths

When a pedestrian is killed by a motorist, the law allows the survivors of the victim to sue the driver for wrongful death. However, before they can make a successful claim, they must prove that the accident was the fault of the driver and not the pedestrian.

If the driver is deemed negligent, then his or her’s insurance will pay the family members and dependents of the deceased for their losses.

Types of Damages in a Wrongful Death

The law allows each family member living with the deceased at the time of death and anyone financially dependant on the deceased to make a claim for their loss.

  • Medical bills before death: The estate is required to pay all decedent’s medical bills, and these can sometimes be claimed as damages in a wrongful death case.
  • Loss of income: This is based on the loss of financial support that the survivors would have received had the person not died.
  • Psychological pain and suffering: The pain and suffering of the deceased pedestrian can’t be claimed by the family, but the anguish and psychological pain of the family can.
  • Loss of companionship and guidance: This is typically claimed by dependent children who were robbed of a parent.
  • Loss of Consortium and companionship: Consortium deals with the loss of intimacy and companionship a spouse would have received.
  • Funeral and burial costs: Based on the reasonable costs to the family for burying the deceased.
