Head-On Collision Kills Three in Palmdale

A tractor trailer and a Nissan pickup truck hit head-on with the impact causing the tractor trailer to erupt in flames. All three occupants of the pickup died, and the truck driver was taken to the hospital with non-life threatening injuries.

According to the Los Angeles County Sheriff’s Department, the accident happened around 7 a.m., Tuesday, July 23, 2019 on Pearblossom Highway between 60th and 70th Streets. Early investigation results suggest that the Nissan truck, which was traveling southbound on Pearblossom, veered over the center line into the path of the tractor trailer traveling northbound.

The collision caused the cab of the big rig truck to erupt in flames. Two of the pickup truck occupants died instantly, and the third was taken to a hospital but died later of his injuries.

Head-On Collision

A head-on collision is one of the most deadly types of crash. The National Highway Traffic Safety Administration reported that head-on collisions only make up 2 percent of the total accident types but apprise 10 percent of all accident fatalities. What makes them so deadly is that the force of the impact is virtually doubled by both vehicles’ mass and speed.

A fully loaded semi-truck can weigh up to 80,000 lbs, and the average passenger car weighs around 3,500 to 4,000 lbs. When they collide, this weight difference means that the smaller vehicle is going to take the worst of the collision. Sometimes this means that all occupants of the smaller motor vehicle become injured or worse.

Passenger Injuries and Deaths

In a typical car accident, the at-fault driver will pay for the injuries and damages of those injured in the victim’s car. However, sometimes the passengers of the at-fault driver are injured or killed, and this creates certain issues with liability. When this happens, there are two primary sources of funds to pay for the passengers’ injuries. The first is the driver’s insurance and can be used to pay for damages even though the injured were passengers in the same car as the at-fault driver.

This is simply because the law allows anyone who is injured by another’s negligence to collect compensation, and an auto policy will pay out any damages the driver caused without regard to where the injured were when the accident happened.

The second source for the passengers is their own insurance policy, if they have one. Also, if that policy had uninsured/underisnured motorists coverage, then the passenger can use that for their own injuries if the driver is uninsured or doesn’t have enough to cover the losses of the injured.

Passenger Wrongful Death Claims

When the an injury turns into a tragedy and a passenger dies from injuries sustained by the fault of the same car’s driver, then the same sources of insurance will also pay out for a wrongful death. This is true even if the driver also died, because the insurance policy covers the acts of the driver at the moment of the accident, and even though coverage technically ends when the driver dies, the insurance company will still pay for the damages.

This is also true if the passengers have UM/UIM and have died. UM/UIM pays for all types of damages the same as a typical insurance police covering the damages caused by the policy holder.
